Terms and Conditions

§ 1 Scope

These Terms and Conditions govern all services of itanic GmbH (hereinafter "Provider") in connection with the scoon platform (website scoon-app.com and the scoon app). They apply to both consumers and businesses unless otherwise specified.

By registering on the platform or using the scoon app, the user accepts these Terms.

§ 2 Description of Services

scoon is a location platform for photographers, videographers, content creators and anyone who wants to discover locations. The platform enables:

  • Discovery and management of photo and video locations
  • Uploading and sharing your own spot photos and information
  • Monetisation through the Creator Revenue System (20% of scoon revenue)
  • Bookings and direct communication between creators and clients
  • Access to scouting tools (sun position, weather, moodboard, etc.)

§ 3 Early Bird Programme

3.1 The first 100 registered and verified users (Early Birds) receive Lifetime Free-Access to scoon Pro + Studio (value: €29/mo × 12 = €348/year) plus lifetime participation in the Creator Pool.

3.2 Early Bird status is only granted after successful verification (minimum 5 quality-approved photos of locations). Registration alone secures the spot, but verification is required to activate all benefits.

3.3 After the first 100 Early Bird spots, further users receive Early Access via TestFlight/Preflight with lifetime participation in the Creator Pool, but without Lifetime Free-Access to Pro + Studio.

3.7 Platform dependency: All Early Bird benefits, including Lifetime Free-Access and lifetime creator earnings, are contingent on the continued active operation of scoon by itanic GmbH. Should the platform be permanently discontinued, no further claims or compensation arise from Early Bird status.

3.4 Real identity requirement: Registration must be completed using the user's real name and a valid, actively monitored e-mail address. Registrations with false names, aliases or invalid e-mail addresses will be rejected and the Early Bird spot will be reallocated to the next creator on the waitlist without prior notice.

3.5 Active use requirement: 7-day rule: scoon's mission is to build a high-quality platform with genuinely active creators. Accordingly, Early Bird users are required to actively use the app within 7 days of their personal TestFlight or Google Play Preflight access being granted. Users who do not open and use the app within this period will lose their Early Bird status. The spot will be passed to the next creator on the waitlist. This rule exists to ensure that every Early Bird spot is occupied by a creator who is truly committed to contributing to the scoon community.

3.6 The Provider reserves the right to verify identities and to reject or remove registrations that do not meet these requirements, at any time and without compensation.

§ 4 Creator Revenue System

4.1 Prerequisite: active Pro subscription: Participation in the Creator Revenue System requires an active, paid scoon Pro or scoon Studio subscription. Users without an active paid subscription are not entitled to receive payouts. Accumulated credit does not expire, but payouts will only resume after reactivation of a paid subscription.

4.2 Cancellation and loss of payout eligibility: Upon cancellation or expiry of a Pro or Studio subscription, the right to ongoing revenue distributions ceases. Credit already exceeding €10 will be paid out in the current billing month. Amounts below €10 remain in the account and become payable again upon reactivation of a paid subscription.

4.3 Minimum payout amount: Payouts are made exclusively when the minimum balance of €10 is reached. Amounts below this threshold are accumulated and paid out once the threshold is met and an active paid subscription exists.

4.4 Early Bird exception: Users with confirmed Early Bird status (first 100 verified creators) retain payout eligibility for life, without requiring a paid subscription. The €10 minimum payout threshold still applies to Early Birds.

4.5 Distribution: 20% of scoon's monthly net revenue is distributed proportionally based on the Likes received by each creator's locations. Payouts are made monthly to the registered account. All payout entitlements and lifetime commissions apply exclusively for as long as scoon is actively operated by itanic GmbH. Should the platform be permanently discontinued, all payout obligations cease without compensation, unless statutory provisions require otherwise.

4.6 The Provider reserves the right to adjust the revenue model with 30 days' prior notice if economic reasons require it.

4.7 No entitlement to a specific amount arises. Earnings depend on platform usage and the popularity of listed locations. The terms “lifetime” and “lifelong” in the context of creator earnings refer to the duration of scoon's active operation by itanic GmbH, not the user's natural lifetime. Should scoon cease operations, no further payouts will be made and no compensation claims arise from this.

§ 5 User Obligations, Photo Standards and Prohibited Content

5.1 Photo and Content Standards

scoon is committed to delivering a genuinely high-quality platform. All content must meet the following standards:

  • Location photos (primary/cover image): The first photo submitted for a location must show the location itself: the actual place, spot or scenery. No people, portraits or staged shots as the primary location image.
  • Additional photos: Additional photos uploaded to an existing location may also include people, portraits, atmospheric shots or creative interpretations of the spot, provided the location remains recognisable or the creative context is clear.
  • No stock photos: All photos must be original shots taken by the uploading user. Stock photos, AI-generated images, purchased photos or photos taken by third parties without explicit authorisation are strictly prohibited.
  • Copyright: Users may only upload photos for which they hold all rights. No use of photos, artworks, logos, brand elements or other protected material belonging to third parties without their written consent.
  • No personality rights violations: Photos of identifiable persons require the written consent of those persons (right to one's own image, §78 Austrian Copyright Act). Photos of minors require the written consent of a legal guardian. Photos taken covertly or without consent are prohibited.
  • No data protection violations: Photos must not inadvertently display protected personal data (e.g., licence plates, ID documents, home addresses) in a way that violates the GDPR.
  • No trespass or illegal access: Photos of locations that were accessed unlawfully (trespass, breaking and entering, unauthorised entry to private property or restricted areas) are prohibited.
  • Quality standard: Photos must meet a minimum technical quality level (sharpness, exposure, framing). The scoon team manually reviews all submissions and reserves the right to reject images that do not meet the quality standard without providing reasons.

5.2 Other Prohibited Content

  • False or misleading location information (incorrect GPS data, wrong city, fabricated descriptions)
  • Obscene, violent, discriminatory, racist or otherwise unlawful content
  • Content that glorifies or promotes illegal activities
  • Spam, automated mass uploads, bot activity or artificial engagement manipulation
  • Commercial advertising for third-party products, brands or services without prior written consent from the Provider
  • Content that infringes trademark law, competition law or other intellectual property rights

The Provider reserves the right to remove content without stating reasons and to suspend or permanently ban accounts in the event of violations. Repeated or serious violations will result in permanent exclusion from the platform, including loss of Early Bird status and all associated privileges.

§ 6 Verification and Quality Control

scoon's core promise to its community is a genuinely high-quality platform with the best spots, the most beautiful photos, and joy in creative expression. To uphold this promise, every submitted spot and photo is reviewed manually by the scoon team before publication.

The Provider reserves the right to reject content that does not meet quality, legal or community standards without stating reasons. Rejection does not give rise to any claim for compensation.

In the event of repeated low-quality submissions, the Provider may temporarily or permanently restrict a user's upload rights. The Provider will notify the affected user of this restriction by e-mail.

§ 7 Bookings and Mediation

7.1 scoon mediates contact between creators and booking users. The Provider does not itself become a party to contracts concluded between users.

7.2 For Early Bird users, no commission is charged on direct bookings. The booking system may introduce a market-standard commission with prior notice.

7.3 Disputes between users must be resolved directly between them. The Provider accepts no liability for services or payments between users.

§ 8 Prices and Subscriptions

scoon offers the following subscription tiers (after public release):

  • Free: Basic use, free of charge
  • Pro: Extended features (pricing published at launch)
  • Studio: Team features and moodboard (€29/month or €348/year)

Early Birds receive Pro + Studio free for life. Price changes will be communicated with 30 days' advance notice.

§ 9 Changes to Prices, Design and Features

9.1 The Provider reserves the right to change prices, subscription rates and billing models at any time. Price changes will be communicated to registered users at least 30 days before taking effect. Annual subscriptions in progress remain at the agreed price until the end of the term.

9.2 The design of the platform, website and app may be changed by the Provider at any time and without notice. No right to retain a particular appearance exists.

9.3 Features and functionality of the platform may be added, changed or removed at any time. This applies in particular to beta features, preview functions and experimental content. Significant changes to the functionality of paid tiers will be communicated with at least 14 days' advance notice.

9.4 Early Bird users are entitled to the functionality of scoon Pro + Studio as of the time of joining. In the event of permanent discontinuation of a core feature, an equivalent replacement will be provided or appropriate compensation granted.

§ 10 Limitation of Liability

The Provider is liable for damages caused by slight negligence only in the event of a breach of essential contractual obligations. Liability in such cases is limited to foreseeable damage. The Provider accepts no liability for the accuracy of location information, accessibility of locations or content provided by users.

§ 11 Privacy

The separate Privacy Policy and the EULA form part of these Terms.

§ 12 Final Provisions

Austrian law applies, excluding conflict-of-law rules. Place of jurisdiction for all disputes is Graz, Austria. Should individual provisions of these Terms be or become invalid, this does not affect the validity of the remaining provisions.

Changes to these Terms will be communicated to users by email. If the user does not object within 30 days, the amended Terms shall be deemed accepted.
